The debate between the panellists and the audience pinned down different views between judges  in house and outside counsels of different jurisdiction on disclosure and the amount of innovation  for non “Anglo-Saxon” jurisdictions that disclosure will bring.

At this early stage of the  European directive life, the discussion also highlighted interesting aspects of existing judgments as to pass on and interest and inconsistencies across jurisdictions on implementation.

The panel on private enforcement closed a two-day conference where market participants, judges, enforcers and practitioners debated the recent enforcement activity and the judicial review major trends.
