The Italian Court of Appeal upheld Linde Medicale in their action against the decision of the Italian Competition Authority

The Italian Court of Appeal on 24 April 2018 annulled the infringement decision of the Italian Competition Authority in relation to an alleged anticompetitive agreement in three tenders for the provision of homecare oxygen and ventilation therapy .

The two largest sanctions concerning the largest tenders were annulled. Furthermore, the Italian Court of Appeal ruled to review the determination of the fine linked to the third tender. Overall, this reduces the total fines originally imposed by 90%.

The CEG economists team led by Dr Barbara Veronese worked on this matter in closed cooperation with NTCM outside NCTM legal counsel to Linde Medicale in the Italian proceedings.
